GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – GENERAL INFORMATION:
The seller, pursuant to and for the purposes of art. 7 of Legislative Decree 9 April 2003, n. 70, informs the buyer that the goods/services subject to this contract are provided by the sole proprietorship Armonia Shop Srls., with registered office in Via devitofrancesco, 2e Bari. Any communication or request for information can be sent by e-mail to info@armoniashop.com. The User is informed, and accepts, that access to www.armoniashop.com does not imply, in any way, the beginning of a commercial relationship with Armonia Shop Srls.
Article 2 – CONCLUSION OF THE CONTRACT:
To make purchases on our website www.armoniashop.com, registration is not necessary; therefore, buyers will be free to register or not on our site without this affecting their purchasing activity. It is understood that it will still be essential to provide Armonia Shop Srls. with all the data requested to activate the purchase. The purchase amount will be calculated as the sum of the cost of all items to be purchased, including VAT, net of shipping costs or any other additional costs communicated at the time of the order. Each registered user of the "www.armoniashop.com" website declares to have full faculty to use credit cards or other payment instruments usable on www.armoniashop.com and that they have sufficient credit to cover all costs related to product purchases through www.armoniashop.com. By selecting the "Pay" button during the purchase process, the buyer declares to fully and unreservedly accept all of these General Terms and Conditions of Sale. www.armoniashop.com will confirm their orders by sending an e-mail. The prices of the goods/services provided, any taxes and duties, as well as additional costs for shipping and packaging are precisely indicated during the order definition, before its confirmation and before payment. www.armoniashop.com reserves the right to modify its prices at any time, but products will be invoiced based on the rates in force at the time the orders are stored (subject to product availability). Products remain the property of the supplier until the total amount due is settled. www.armoniashop.com reserves the right to refuse an order from any customer with whom there is an ongoing dispute. a. Goods are sold and purchased in accordance with an order sent by the buyer and accepted by the seller in the manner set forth in point b. below. The order is subject to these conditions which govern the contract in such a way as to exclude any other conditions and methods under which an order may be made by the buyer. b. Once the products are displayed, it will be possible to choose the one of interest by selecting the "DETAILS" button, which will show a summary page containing the product price data. By selecting the add to cart button, it will be possible to reserve the desired product. On the next screen, the user can verify the types of products they wish to purchase and their relative prices, and at this point, it will be possible to confirm, cancel, or modify the order. c. The seller, pursuant to art. 13 of the aforementioned Legislative Decree no. 70 of 2003, having verified the availability of the chosen product, accepts the buyer's order, without undue delay and by e-mail containing a summary of the general and specific conditions applicable to the contract, information relating to the essential characteristics of the good or service, and a detailed indication of the price, payment methods, right of withdrawal, delivery costs, and applicable taxes. Once the purchase order has been confirmed, the buyer has the possibility to check its details at any time on the relevant web page.
Article 3 – PRICES AND RATES:
The prices of the goods/services provided, any taxes and duties, as well as additional costs for shipping and packaging are precisely indicated during the order definition, before its confirmation.
Article 4 – DELIVERY OF GOODS
Unless otherwise communicated, the products for which the order has been accepted by the seller will be delivered to the courier within 3 working days from the transmission of the order confirmation and/or, in case of payment by bank transfer or credit card, 3 days from the crediting of our accounts and delivered to the address indicated by the buyer in the purchase order. Delivery is made by trusted forwarders and/or couriers at the shipping cost indicated on the screen during the completion of the order, calculated based on the weight, volume, and destination of the goods. The shipping cost is borne by the buyer, according to the rates and costs indicated. Each delivery is considered completed from the moment the carrier makes the products available to the buyer, as resulting from the system used by the carrier to track shipments. It is the recipient's responsibility to check the products upon delivery and to raise any justified reservations and complaints, including the possibility of refusing the package if it has been opened or shows obvious signs of deterioration.
Reservations and complaints must be addressed to Armonia Shop Srls by registered letter with return receipt or by e-mail to the addresses indicated in art. 1.
Article 5 – PAYMENT
Purchases can be settled via:
Bank transfer;
PayPal;
credit card;
prepaid card;
cash on delivery, in which case an additional cost of €5.00 will be applied.
All cards belonging to the Visa, Visa Electron, and MasterCard circuits are accepted, including, therefore, PostePay cards. Credit card data is entered directly on the pages of Armonia Shop Srls's banking partner (PayPal) and is transmitted to the bank's servers in encrypted form according to the 128-bit SSL (Secure Socket Layer) standard, one of the most advanced and effective protection systems currently available. For greater security, only the banking partner has access to the card data used for payment, while Armonia Shop Srls has no possibility of knowing or storing such data. The purchase price will be charged to the buyer's bank account within 4 days from the day of the order and will be effective after authorization confirmation from the banking service center. In the event that the virtual POS (point of sale terminal on the Internet) communicates the refusal of the card, the order will be automatically canceled, informing the buyer online of the aforementioned cancellation. In case of unavailability of the product after the order has already been placed, the buyer will be informed by e-mail of its cancellation. Following such cancellation, the speed of crediting the buyer's bank account will depend on the type of payment selected, the type of credit card, and the conditions of each banking institution.
Article 6 – PRODUCT DESCRIPTIONS
The information provided on each product, as well as its photographs and videos, are published on www.armoniashop.com for guidance purposes only, as are all trade names, trademarks or distinctive symbols of any kind contained on the pages of the website www.armoniashop.com. Should it be necessary, Armonia Shop Srls undertakes to correct as soon as possible any errors and omissions that may occur in the product descriptions.
Article 7 – RIGHT OF WITHDRAWAL
- The buyer has the right to withdraw from the contract stipulated under these general conditions, without any penalty and without specifying the reason, within ten working days from the day of receipt of the goods by the buyer, pursuant to articles 64 et seq. of the Consumer Code (Legislative Decree 22.07.2005 n. 206). The right of withdrawal is exercised by sending, within the prescribed period, a communication sent to the address indicated in art. 1 by registered letter with acknowledgment of receipt. The communication can also be sent, within the same period, by telegram or e-mail to the addresses always indicated in art. 1. Armonia Shop Srls will reply by e-mail providing detailed instructions for return.
- If the goods have been delivered, the buyer who has sent the withdrawal is required to return the goods by shipping them within a period not exceeding 14 days from the date of receipt. The costs and risks associated with the return of the products will be borne by the buyer, who must send them securely with the necessary guarantees for the products to arrive in perfect condition. The only costs due by the buyer for exercising the right of withdrawal according to this article are the shipping costs of the goods to the seller. The seller is obliged to reimburse the amount paid within 14 days from the date of receipt of the returned products.
- Returns cannot take place in any case if the products supplied have clearly been used. Products must be returned with appropriate protection, in their original packaging, in perfect condition (not damaged or soiled), with all accessories, instructions and documentation, with the identification tag and labels still attached. Returns of packages without any element allowing identification of the sender (order number, name, address) will not be accepted.

Article 8 – WARRANTY OF CONFORMITY OF GOODS
- The seller is liable to the buyer for any lack of conformity of the purchased good pursuant to and for the purposes of what is provided by the Consumer Code (Title III - Legal guarantee of conformity and commercial guarantees for consumer goods, CHAPTER I Of the sale of consumer goods, articles 128 et seq. of Legislative Decree 22.07.2005 n. 206), provided that it exists at the time of delivery of the good and manifests itself within a period of two years from the moment of receipt of the goods (one year for buyers with a VAT number pursuant to art. 1495) and provided that it is not a defect known to the buyer at the time of concluding the purchase contract.
- Any defect must be communicated to the seller within two months of its discovery, by sending a registered letter with return receipt to the address referred to in art. 1. The date of the postmark of sending the registered letter will be valid between the parties.
Article 9 – PROTECTION OF PERSONAL DATA
The seller informs the buyer, pursuant to art. 13 of Legislative Decree 30 June 2003, no. 196 (Privacy Code) containing provisions for the protection of persons and other subjects regarding the processing of personal data, that the personal data provided by the buyer or otherwise acquired in the context of the seller's activity, may be processed, in compliance with the aforementioned legislation and Legislative Decree no. 171/98 on privacy in telecommunications. Personal data will be processed by the seller electronically in compliance with maximum confidentiality and will be used solely for the execution of the contract and for the management of the product purchase order.
The communication of personal data is mandatory for the purpose of supplying the goods, and their non-communication will prevent the conclusion and execution of the contract. The data controller is: Armonia Shop Srls
No data processing other than that necessary for the execution of the supply may be carried out without the express consent of the buyer. Pursuant to art. 7 of Legislative Decree 196/03, the buyer has the right to obtain information on the origin of personal data, the purposes and methods of processing, the logic applied in case of processing carried out with the aid of electronic tools. The buyer also has the right to obtain the updating, rectification or, when interested, the integration of data, the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed, the certification that the operations described above have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves a manifestly disproportionate use of means compared to the protected right. Finally, the buyer has the right to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning him, even if pertinent to the purpose of the collection, to the processing of personal data concerning him for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.
To exercise the rights provided by art. 7 of Legislative Decree 196/03, the buyer may address their written request, by registered letter with return receipt, or by e-mail, to the data controllers, sending their request to the addresses referred to in art. 1.
Article 10 – INTELLECTUAL PROPERTY
Armonia Shop Srls reserves all rights to the texts, works, illustrations, and images reproduced on the web pages of the website www.armoniashop.com in accordance with copyright laws as well as intellectual property laws. In this regard and in accordance with the provisions of intellectual property law, use is authorized only for private purposes unless otherwise specified, including further restrictions of the intellectual property code. Any other use is considered counterfeiting and is sanctioned in accordance with intellectual property law, except with prior written authorization from Armonia Shop Srls.
All total or partial reproductions of the www.armoniashop.com catalog are strictly prohibited.
Article 11 – LIABILITY
Armonia Shop Srls is not responsible for damages, both material and immaterial, caused by improper use of the products sold. The liability of Armonia Shop Srls, in any case, will be limited to the amount of the order and cannot be requested for simple errors or omissions that may have occurred despite all precautions adopted in the presentation of the products. Armonia Shop Srls cannot be held liable to a buyer or a third party for any indirect damage, loss, profit, or business volume incurred in any way, even if they were reasonably foreseeable by Armonia Shop Srls. Without limiting the preceding clauses, Armonia Shop Srls's liability under these general conditions cannot exceed a sum equal to the amounts paid or to be paid for the transaction originating said liability, whatever the cause or form of the action in question. Armonia Shop Srls cannot be held responsible for non-fulfillment of the contract in case of stock failures or product unavailability, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communication, flood or fire. In case of dispute, the buyer will contact Armonia Shop Srls to obtain an amicable solution. Furthermore: Armonia Shop Srls is not responsible for the improper use that may be made of the contents of its web pages, being the exclusive responsibility of those who access and use them; such improper use includes the following behaviors;
- Reproducing or copying, distributing, allowing public access through any publishing method, transforming or modifying the content, unless authorized by the owner of the relevant rights or unless the action is legally permitted.
- Deleting, circumventing, or manipulating the "copyright" and other significant information about the rights of the owners incorporated in the pages of www.armoniashop.com, as well as the technical protection devices, or any information mechanism that the pages of www.armoniashop.com may contain.
- Using the pages of www.armoniashop.com available to users to insert messages that do not have a direct correlation with the content of Armonia Shop Srls's activity, in particular, illegal, illicit, defamatory content or any other content that may harm the rights of third parties or damage computer systems. www.armoniashop.com reserves the right to remove any message that it deems inappropriate. Armonia Shop Srls disclaims any responsibility arising from the exchange of information between Users through www.armoniashop.com.
The responsibility for statements disseminated on its web pages is attributed to those who make them.
Article 12 – DISPUTE RESOLUTION
For all civil disputes concerning this contract or connected thereto, which may arise between the parties, the mandatory territorial jurisdiction is that of the judge of the place of residence or domicile of the buyer, if located in the territory of the State, as established by art. 63 of Legislative Decree no. 206 of 6 September 2005 "consumer code", regarding the competent court.
Article 13 – ACCESS TO THE CONTRACT AND THESE GENERAL CONDITIONS
A copy of these General Conditions, pursuant to art. 12, paragraph 3 of Legislative Decree 9 April 2003, no. 70, can be downloaded and saved on the buyer's computer.
Article 14 – AMENDMENTS TO THESE GENERAL CONDITIONS
Armonia Shop Srls reserves the right to modify these general terms and conditions of sale without notice, being able to change, delete or add both the contents and services provided through the site and the format in which they appear or are represented on its servers. These changes will be effective from the moment of their publication on the website www.armoniashop.com and must be accepted by the buyer each time a purchase is made through the website www.armoniashop.com.
Any customs duties and expenses shall be borne by the recipient.
Article 15 – EXHAUSTIVENESS
The purchase does not entail any other charges, obligations, or expenses for the buyer than those established in the contract.
